What are the employment rule in Australia?

In Australia, employers must retain employment records for at least 7 years (duration may vary in other countries). According to the Fair Work Act 2009, it is mandatory to:

  • Employment/ contract indicating start and termination dates
  • Record and provide regular payslips detailing date, hours worked, pay, and overtime
  • Applicable employment agreement, award, or contract
  • Leave accruals (annual leave, personal leave)
  • Superannuation fund and contribution details
  • Trade certificates and necessary qualifications (e.g., RSA, Working with Children Check)
  • Work entitlement documents (e.g., Visa/VEVO checks)
